Terms of Service

By creating an account or using Clearmind, you agree to these Terms of Service. Please read them carefully before using the programme.

1. The Service

Clearmind is a professional learning and development programme delivered by Marco Casavecchia, a human and organisational development consultant operating as a sole professional under Italian regime forfettario (ATECO 70.20.09 — business consulting and management).

The programme is available in two modalities:

Self-directed online programme — a structured 8 to 10 week journey delivered as a web application at app.iclearmind.com, designed to help individuals understand and change the thinking patterns and habits that drive worry, rumination, and unhelpful ways of relating to their own thoughts. This modality is available as a subscription.

Direct consultation — individual sessions with the consultant, available on request in English, Italian, and Spanish. Direct consultation may be requested before, during, or after the self-directed programme. Session availability and fees are agreed directly with the consultant via iosonomarco@gmail.com.

Both modalities form part of the same professional practice and are governed by these Terms.

2. Not a Medical or Therapeutic Service

Clearmind is a structured educational and self-directed learning programme. It is not a medical service, a clinical therapy, or a substitute for professional mental health treatment. If you are experiencing a mental health crisis, please contact a qualified mental health professional or your local emergency services. Crisis resources are available within the app under Settings → Crisis Resources.

The programme is designed for use by adults who are functioning in daily life and wish to develop greater self-awareness and a different relationship with their own thinking habits. It is not suitable for individuals currently experiencing acute psychiatric conditions.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at iosonomarco@gmail.com if you become aware of any unauthorised use of your account.

You may not share your account with others or create multiple accounts.

5. Subscription and Payment

Discovery tier (free): Phase 1 of the programme (exercises 1–4) is available free of charge without a subscription.

Journey subscription (€59.99/year): Full access to all seven phases, thirty exercises, and condition-specific modules. Billed annually.

Renewal (€39.99/year): Reduced rate for annual renewal of an existing subscription.

Companion access (permanent): Upon completing the full programme (all 30 exercises), core tools are retained permanently at no additional cost, even if your subscription lapses.

All prices are inclusive of any applicable taxes. Payments are processed by Stripe, Inc. Your subscription renews automatically at the renewal rate unless cancelled before the renewal date.

6. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access until then.

Under EU consumer law (Directive 2011/83/EU), you have a 14-day right of withdrawal from the date of purchase. If you have not yet accessed the paid content (Phases 2–7), you may request a full refund within this period by contacting iosonomarco@gmail.com.

If you have accessed paid content within the 14-day withdrawal period, you expressly acknowledge that the right of withdrawal is waived in accordance with Art. 59(a) of Directive 2011/83/EU, as the digital content has been delivered with your prior consent.

7. Intellectual Property

All content within Clearmind — including the programme structure, exercise content, framework adaptations, copy, design, and code — is the intellectual property of Marco Casavecchia and is protected by Italian and EU copyright law.

You are granted a personal, non-transferable, non-exclusive licence to access and use the programme content for your own personal development. You may not reproduce, distribute, modify, or create derivative works from any part of the programme without prior written permission.

We aim to keep Clearmind available at all times but cannot guarantee uninterrupted access. We may temporarily suspend the service for maintenance or updates.

We reserve the right to modify, update, or discontinue any part of the programme. We will provide reasonable notice of significant changes that affect your subscription.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Marco Casavecchia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Clearmind.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

This limitation does not affect your statutory rights as a consumer under Italian or EU law.

11. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Frosinone (FR), Italy, without prejudice to your rights as a consumer to bring proceedings in your country of residence under applicable EU consumer protection law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice within the app. Continued use of Clearmind after notification constitutes acceptance of the updated Terms.
